By ordering an art design or commission piece from me, you automatically accept and agree to the following terms and guidelines.(This document will always be attached to sales invoices for later reference.)
General
• Clients must be of legal age (18 years or older) to order commissions or purchase designs from The Ravens Tale. The Ravens Tale will not be held responsible for any false information given regarding the client's age and legality should complications occur.
• When ordering a commission from The Ravens Tale, the artist will be permitted 2 months, after the full payment is made, to complete your order. If complications (such as technological errors or tragedy) occur, you will be contacted promptly and given the decision to either request a full/partial refund (depending on progress status) or extend the deadline for the order.
• The Ravens Tale will present you with an initial rough sketch for your approval before completing a commission piece. It is at this time in which you are expected to request any free alterations. After this step, any further requested alterations may come with an extra fee.
• Purchases/orders will be delivered to you as a digital PNG file in its original file and resolution size through either your e-mail or through Social Media DMs, which does not require shipping and handling.
• The Ravens Tale's watermark will not be present on your personal copy of commission order pieces, however the artist's signature may appear on your copy of the image(s) in a tasteful manner. The artist's signature may not be altered or removed by the client, unless otherwise discussed with and agreed upon by The Ravens Tale.
Payment
• Payment for commissions under $100 USD must be paid in full before the artist can begin working on a commission piece. Commissions above $100 USD may be paid half upfront and half when the initial sketch is sent to the client. Once the second half of payment is sent, the artist can complete the commission.
• Any transactions made through Paypal will be initiated by The Ravens Tale with an invoice.
• Commission orders may not be refunded after payment, unless the artist fails to meet the deadline of an order, in which you will be refunded in full.
Copyright & Permissions
• Clients are not permitted under any circumstances to use any part of commissioned work from The Ravens Tale such as images, goods, and copies of goods in any block-chain related technology including non fungible tokens (NFT), cryptocurrency, or future inventions in the space. Using any commissioned work is also strictly prohibited from use in any advertising or profits associated with block-chain related technology including non fungible tokens (NFT), cryptocurrency, or future inventions in the space.
• Any aspect of work by The Ravens Tale may not be used to train, validate, or test any neural network or artificial intelligence (AI). Doing so is in violation of terms against alteration and external non private use of assets created for patrons.
• You are not permitted to utilize commission order pieces created by The Ravens Tale for profit or commercial use, unless otherwise discussed and agreed upon by The Ravens Tale.
• You are paying for a service, not a tangible good. Therefore, The Ravens Tale retains all rights and ownership to the commission order or design illustration piece(s). Being so, The Ravens Tale is free to display purchased commission pieces for portfolio use, advertisement, promotional use, etc...
• The Ravens Tale will not attempt to claim ownership of a character design or story plot initially created by the client.
• You are permitted to post the smaller, watermarked copy of your commission orders or Adoptable designs made by The Ravens Tale on social media (such as Toyhouse, Instagram, etc...). You are however required to properly credit back to The Ravens Tale with a functional link/referral to the artist's own website, profile, and/or social media (Tumblr or Bluesky @the-ravens-tale).
• You are not permitted to trace, recolor, or repurpose aspects of a commission order or Adoptable design illustration piece created by The Ravens Tale.
• You may use the artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays.
• You reserve the right to print or create an otherwise physical reproduction of the Artwork as long as it is for your PERSONAL use only (ie. NOT for sale). You may not use the artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.) unless otherwise discussed.
Adoptables
• All applicable terms in previous sections still apply to Adoptable designs made by The Ravens Tale.
• Buyers are expected to deliver payment within 24 hours of claiming, otherwise the design will go to the next buyer offering.
• Please do not send payment until The Ravens Tale has confirmed your claim on an Adoptable design.
• All designs purchased from The Ravens Tale are for Non-Commercial use only. Redistribution of the character art and design drawn by The Ravens Tale in the form of merchandise or profitable media is prohibited unless discussed otherwise and agreed upon.
• The Ravens Tale will not make changes to completed designs/adoptables. You are allowed to make changes to the design after purchase, however, please DO NOT edit, alter, add or draw on the art/original design.
• You are not permitted to trade or resell any Adoptable designs made by The Ravens Tale.
• All Adoptable design sales are final. No refunds will be granted after a transaction has been made.
